Allahabad High Court Rejects Muslim Side’s Plea in Krishna Janmabhoomi Case, Paves Way for Trial

In a significant development in the Krishna Janmabhoomi-Shahi Eidgah dispute, the Allahabad High Court dismissed the plea filed by the Muslim side challenging the maintainability of multiple suits. These suits, filed by the Hindu side, seek the removal of the Shahi Eidgah mosque and the restoration of the Krishna Janmabhoomi temple in Mathura. The judgment, delivered by Justice Mayank Kumar Jain, clears the path for the trial to proceed.

Advocate Vishnu Shankar Jain, representing the Hindu side, expressed readiness to face any appeal in the Supreme Court, as the Muslim side, including the Shahi Eidgah Masjid management committee and the UP Sunni Central Waqf Board, may challenge the ruling. The court’s decision rejected the application under Order 7 Rule 11 filed by the mosque, stating that the suits are not barred by the Places of Worship Act, 1991.

The Hindu litigants argue that the mosque, built during the reign of Aurangzeb in 1669-70, stands on the site of a demolished temple. They seek the mosque’s removal from the shared 13.37-acre complex and possession of the premises. The Muslim side contends that the suits are invalid under the Places of Worship Act. The next hearing is scheduled for August 12, where the court will continue deliberating on the case. The outcome of this dispute could have significant implications for the religious and legal landscape in India.
