High Court Upholds Divorce for Hisar Construction Firm Owner, Orders ₹8 Crore Alimony
The Punjab and Haryana High Court recently upheld a 2018 decision by a Hisar family court granting divorce to the owner of a construction firm with an annual turnover of ₹2500 crore. The court, comprising Justice Sudhir Singh and Justice Harsh Bunger, also ordered the Gurugram-based infrastructure firm owner to pay ₹8 crore as alimony to his wife.
The divorce was granted due to the bitter and acrimonious nature of the marital relationship, which had deteriorated over the years. The husband filed for divorce in 2015, citing the rude and quarrelsome behavior of his wife towards him and his family since the beginning of their marriage in 1995. The wife denied the allegations, claiming that the husband’s success had led to his mistreatment of her, as he wanted to marry again.
The court observed that continuing the facade of the broken marriage would be unjust to both parties, as irretrievable breakdowns in marital relationships constitute cruelty to both spouses. It concluded that the marriage had failed beyond repair, and forcing the parties to remain together would only perpetuate mental stress and strain. Therefore, the court granted the divorce and awarded ₹8 crore alimony to the wife, considering the husband’s good financial standing.
This verdict underscores the court’s commitment to ensuring justice and fairness in matrimonial disputes, prioritizing the well-being and dignity of both parties involved.
